What is Personal Injury?
Personal injury law in California deals with legal disputes that arise when one person suffers harm from an accident or injury, and someone else might be legally responsible for that harm.
Most personal injury cases are based on negligence. To win a negligence case, the plaintiff must prove that the defendant owed a duty of care, breached that duty, and caused the plaintiff's injuries as a result.
California follows a "pure comparative negligence" rule, meaning that even if the plaintiff is partially at fault for their own injuries, they can still recover damages. However, their compensation will be reduced by their percentage of fault.
Plaintiffs can recover various types of damages, including medical expenses, lost wages, pain and suffering, and punitive damages (in cases of egregious wrongdoing). The statute of limitations for personal injury cases is generally two years from the date of the injury.
Common types of personal injury cases include:
- Car Accidents: These are among the most common personal injury claims. Victims may seek compensation for injuries sustained in crashes caused by another driver’s negligence.
- Slip and Fall Accidents: Property owners can be held liable if someone slips, trips, or falls due to dangerous conditions on their property that they knew or should have known about.
- Medical Malpractice: These cases arise when healthcare providers fail to provide the standard of care, resulting in injury or death to the patient.
- Product Liability: Manufacturers, distributors, and retailers can be held liable for injuries caused by defective or dangerous products.
- Workplace Accidents: While workers' compensation typically covers workplace injuries, there are cases where a third party (other than the employer) can be held liable.
- Dog Bites: California has strict liability laws for dog owners. If a dog bites someone, the owner is liable, regardless of the dog’s history.
- Wrongful Death: These cases involve fatalities caused by someone else's negligence or intentional actions. Family members of the deceased can file a lawsuit for damages.
